This website is operated EseaCruising.com and is a Licensed Travel Agent No 182 Headquartered in Darwin Northern Territory.  In these terms "EseaCrusing.com" means EseaCruising.com trading as Muskins Pty Ltd ATF Muspratt Business Trust.

Using this website:

Using this web site means you accept to these following terms and conditions. If you do not agree to these terms, do not use our web site for your reservations. EseaCruising.com may at any time modify these terms on this site and your continued use of this site is subject to the terms in force at the time of use. You must be 18 years of age or older.

Agency:
EseaCruising.com acts as agent for the third party suppliers of the travel products and services advertised on this web site. Many suppliers impose special conditions on their products and services as well as control to inventory availability and pricing. These conditions apply in addition to EseaCruising.com's terms. For example, suppliers may have rules and restrictions about the use and availability of fares, products and services, refund and cancellation policies and the limitation or exclusion of liability for death, personal injury, delay and loss or damage to baggage. It is your responsibility to check those conditions before you make a booking. Once you make a booking, you are bound by the conditions applicable to the relevant supplier, should you require a copy of the suppliers terms and conditions these are generally found in their brochure or you could ask your EseaCruising.com consultant for a copy prior to confirming and paying for your reservation.

All information is subject to change without notice. The products and services sold through EseaCruising.com are subject to availability and can be withdrawn or varied without notice.

Prices:
All prices listed on our website are subject to availability and can be withdrawn or varied without notice.

Travel Documents:
Travel documents include (without limitation) airline tickets, cruise tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. All travel documents are non-transferable. All airline tickets must be issued in the name of the passport/photo identity holder, some carriers will deny carriage if the name varies and the booking may be cancelled. Approximately 40 days prior to departure EseaCruising.com will endeavour to send out your travel documents (either by email or regular post) It is your responsibility to ensure you have received all travel documents from us prior to travel. An option of Registered Post or Express Post is available for travel documents however should you request that your documents are sent out by Registered or Express Post additional charges apply.

Schedule Changes:
It is your responsibility to contact the airline/cruiseline/tour operator prior to travel to ensure the scheduled departure time has not changed.

Travel Insurance:
Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel.

Chartis Insurance (Formerly AIG Travel) offers all EseaCruising.com clients a 20% discount for travel insurance purchased through our website. To decide if a policy is right for you, please carefully read the relevant Product Disclosure Statement and Policy Wording available. It is recommended you purchase travel insurance at the time of making a deposit.

It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. If you need information regarding visa and other travel document requirements for your trip please let us know. We can obtain such information from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage, which you may suffer in reliance on it.

Disclosure

Passports & Visas:
It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of entry. If you need information regarding visa and other travel document requirements for your trip please let us know. We can obtain such information from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage, which you may suffer in reliance on it.

PLEASE NOTE: For all international cruises, you must ensure your Australian passport has a validity of six months after your return date to Australia. In the event that you are travelling to a country or countries which do not require a visa for Australian passport holders, you must tell us if you have been arrested or convicted in respect of any offence or breach of law. Non-disclosure of this information may lead to your being refused entry on arrival in certain countries. In that event, we take no responsibility whatsoever. If you do not wish to disclose such information to us, then you must contact the embassy of each country of destination and make your own arrangements in regard to entry to that country.

Carry-on Baggage at International Airports:
To increase your safety, there are new rules for taking liquids, aerosols and gels on flights into and out of Australia. These new rules are needed to protect you from the threat of liquid explosives. They are in effect as of 31 March 2007.

Health:
It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. It is best to contact your General Practitioner or Family Doctor for further advice.

Taxes:
Certain taxes are mandatory in various countries. There may also be an additional local tax charged at some ports – this will be advised to you at the time of confirming your reservation. All taxes are subject to change without notice.

Cancellation Fees:
We are unable to provide a refund to you until we receive the funds from the relevant supplier. Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees will also apply where a booking is changed or tickets are reissued.

Most tickets are non changeable/non-refundable. If your ticket is refundable we will require notification of your cancellation in writing. Once we have received your written notification we will cancel your relevant travel arrangements and submit your booking to the relevant supplier for refund. Suppliers can take around 8-12 weeks to process a refund. We are unable to provide a refund to you until we receive the funds from the relevant supplier. Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Both airline and/or supplier and EseaCruising.com cancellation fees will apply. Fees will also apply where a booking is changed or tickets are reissued.

Where amendment of a booking is permitted, a amendment fee of $50 AUD will apply payable to the Agent for each permitted amendment in addition to any applicable supplier fees. Before entering into a transaction, you should carefully check to see whether any other cancellation or amendment fees apply. We reserve the right to refuse service to any client we feel is not genuine in their desire to transact with EseaCruising.com according to our terms and conditions. Excessive booking requests coupled with the repeated failure to complete transactions by providing requisite payments will be deemed deliberate time-wasting and, at our discretion, may result in the refusal to provide service

Agency:
EseaCruising.com acts as a travel agent only. We sell various travel related products on behalf of numerous transport, accommodation and other wholesale service providers, such as hotel, tour, transfers, airlines and cruise line operators. EseaCruising.com's obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not EseaCruising.com. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with EseaCruising.com.

Liability:
We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.

Credit Card Transactions:

All EseaCruising.com's credit card payments are processed by PayPal. PayPal only accepts Visa or Master Card and you need not have a PayPal Account to use this service. Credit card surcharges of 2.5% apply when paying by credit card. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against that provider, and not against EseaCruising.com. In the event that payment has been made to EseaCruising.com by credit card, you agree that you will not seek to charge back your payment to EseaCruising.com.

ESEACRUISING.COM NO OBLIGATION POLICY:

EseaCruising.com Fair Use Policy.
As a convenience to consumers EseaCruising.com offers our customers a NO OBLIGATION period of up to 5 days. During this NO OBLIGATION period when cabins are available, EseaCruising.com kindly holds a cabin for up to 5 business days with no deposit or payment required.

The NO OBLIGATION period is provided to customers as a good will gesture. However to ensure fairness in the number of cabins held, for all no obligation period reservations the EseaCruising.com FAIR USE POLICY applies.

* The EseaCruising.com No Obligation Reservation Policy: We understand that at times there are things you need to arrange before committing to one of our fantastic offers. As availability is STRICTLY LIMITED, to avoid disappointment, EseaCruising.com offers you the EseaCruising.com No Obligation Reservation Policy where we will hold your cruise with no deposit or payment upfront for up to 5 days. The 5 day period is subject to our suppliers discretion of how many days we can hold your cruise without a deposit payment  to them, but as a guide, the normal no obligation period is as follows:

Cunard Cruises: No Obligation for Up to 5 Days unless sailing within less than 20 days, full payment is required upfront.

P&O Cruises Australia – No Obligation for Up to 3 Days unless sailing within less than 20 days, full payment is required upfront.

Princess Cruises: No Obligation for Up to 5 Days unless sailing within less than 20 days, full payment is required upfront.

Royal Caribbean Cruises – No Obligation for Up to 5 Days unless sailing within less than 20 days, full payment is required upfront.

Holland America Line: No Obligation for Up to 5 Days unless sailing within less than 20 days, full payment is required upfront.

All other cruiselines varies please speak to one of our dedicated Cruise Specialist for full details.

Whilst the published No Obligation Policy timeframe advised is correct at the time of publication, the policy can change without notice at each individual cruiseline’s discretion.

The ESEACRUISING.COM No Obligation policy is subject to the conditions of the ESEACRUISING.COM FAIR USE POLICY.

This policy aims to ensure we are able to provide quality reservations services to all of our customers, and no customers are disadvantaged by the behaviour of others.

This policy applies where:

(i) there is a:

(A) Number of reservations held under the NO OBLIGATION policy which remains unpaid.

(B) Number of duplicate reservations held for one particular customer which remains unpaid.

How the FAIR USE POLICY works:

Should a customer be found to be making an unreasonable number of no obligation reservations via EseaCruising.com without making a deposit or payment on a reservation (not confirming the reservation), EseaCruising.com reserves the right to NOT PROCESS anymore NO OBLIGATION reservations after the SAME CLIENT has made TWO OR MORE reservations within a 12 month period without fulfilling the reservation (without paying a deposit/final payment when booking has been confirmed) unless a non-refundable deposit of $100 per passenger is paid up front.

How we determine if you have made TWO OR MORE NO OBLIGATION reservations within the last 12 months:

Our system is able to identify customers who have made 2 or more unpaid No Obligation policies within the last 12 months through the passenger details, email address, home address and phone number used at the time of making a reservation.

What this means for users on our website:

- If you have made TWO OR MORE NO OBLIGATION RESERVATIONS ON ESEACRUISING.COM within the PAST 12 MONTHS our reservations team will NOT Process your reservation online. YOU MUST CALL OUR RESERVATIONS CENTRE to book and an upfront non-refundable deposit of $100 per passenger will be charged via CREDIT CARD INSTANTLY.

The QUALITY of service ESEACRUISING.COM provides is important to our customers and therefore unfortunately we are unable to continuously process reservations for clients who don’t proceed with their reservation on an on-going basis.

This policy aims to ensure we are able to provide quality reservations services to all of our customers, and no customers are disadvantaged by the behaviour of others.
